CNN Won Its Press Pass Back in Court, Then Lost Its Air Force One Seat to Real America’s Voice

CNN won its press passes back in court this week. It did not get its seat on Air Force One. When President Trump flew to Knoxville, Tennessee, on Saturday, Sept. 26, 2026, for the Tennessee–Texas college football game, White House guidance left CNN off the flight and named Real America’s Voice instead.

The swap is small in square footage and large in symbolism. For decades, that seat has been reserved for one of five legacy television networks. On Saturday it went to a conservative outlet the legacy press has spent years dismissing.

What the judge ordered, and what he didn’t

The fight began on Sept. 18, when Trump announced that CNN, MS NOW and Politico were banned from the White House over what he called fake news. The three outlets sued on Monday, Sept. 21, and the case went to U.S. District Judge Timothy J. Kelly, a Trump appointee.

In an overnight ruling early Thursday, Sept. 24, Kelly temporarily struck down the ban and ordered the outlets’ credentials restored for 14 days. According to Newsweek, he wrote that the outlets were “likely to succeed in showing that their hard passes were revoked without constitutionally adequate due process.”

But as the Associated Press reported, Kelly’s order addressed “hard passes” to the White House grounds. It did not directly address pool duties or Air Force One. That distinction is the whole story. A hard pass lets a reporter walk onto the grounds. A seat on the president’s plane is a separate assignment, and the White House decides who rides.

Theodore Boutrous Jr., the lawyer for the three outlets, had said on CNN that the plaintiffs believed the ruling covered pool access as well, the AP reported. CNN senior legal analyst Elie Honig was more careful, telling viewers the move “clearly violates the spirit of the judge’s order” while calling it “a bit of an open question” whether it violated the technical letter, according to Newsweek.

How the pool works

The television pool was created decades ago by the White House Correspondents’ Association. Five networks share it on a rotating basis: ABC, CBS, CNN, Fox News and NBC. Whichever one is up shoots video of the president and shares it with the others.

When the White House barred CNN, MS NOW and Politico from the grounds, the other four pool networks declined to participate in a show of solidarity, the AP reported, leaving the pool without live video of the president for several days. The pool briefly came back on Friday, Sept. 25, and CNN handled pool duty for Trump’s meeting with Chinese President Xi Jinping at the National Archives. Then came Friday night’s guidance for the Tennessee trip, and CNN’s name was not on it.

CNN confirmed to Newsweek that it had been left off and declined further comment. A written pool report on Saturday morning confirmed there was “no TV pool” for the trip. The White House did not respond to the AP’s requests for comment.

Real America’s Voice takes the seat

Real America’s Voice White House correspondent Taylor Mitchell reported from Joint Base Andrews before the flight. “Real America’s Voice is in the pool. CNN is not,” Mitchell said, according to the network. In a video quoted by HuffPost, Mitchell added: “CNN is not here; we have taken over that responsibility.”

The network said it would make its full presidential feed available to other outlets, legacy media included. RAV’s Parker Sigg put the network’s view bluntly: “There’s been a monopoly on this space for decades.”

Trump, for his part, made his position plain on social media Saturday morning: “FAKE NEWS SHOULD NOT BE ALLOWED IN THE WHITE HOUSE!!!” Fans filmed Air Force One making a low-altitude flyover as the teams warmed up, and when the motorcade arrived during the national anthem, the president appeared on the stadium screen to cheers, according to the pool’s text report.

The real question

The networks and their defenders call this an attack on the free press. It is worth being precise about what was actually lost. CNN can still report on the president. It can broadcast, publish, book guests, quote the pool feed and, under Kelly’s order, walk onto the White House grounds. What it did not get on Saturday was a seat on the president’s plane.

There is a legitimate debate about whether any president should pick which outlets travel with him, and the courts will keep weighing in. But the legacy pool was always an arrangement among a handful of networks, not a constitutional entitlement. For years, those same networks treated outlets like Real America’s Voice as fringe. On Saturday, the fringe outlet was the one on the tarmac with a camera, offering its feed to everyone, including the networks that sat out.

Trump is not finished, either. The administration has already launched its own 24-hour video stream, and the legal fight over the bans is still in its early stages. The old gatekeepers are discovering that the gate was never theirs.

CNN won its hard pass back in court, but it turns out nobody has a constitutional right to a seat on Air Force One.
