More than 70 FBI photographs from the searches of Joe Biden’s Wilmington, Delaware, home and the Penn Biden Center in Washington are now public, and the contrast with the Mar-a-Lago raid is hard to miss. The images, obtained by the conservative watchdog group The Oversight Project and first published by The Federalist on Sept. 21, 2026, show Biden’s records in boxes, binders and a drawer, with agents in several frames wearing gloves.
Compare that to the one image of Donald Trump’s documents that the country saw over and over: classified papers spread across a carpet at Mar-a-Lago, topped with classification cover sheets that, by the government’s own later admission, FBI agents had put there.
What the new photos show
According to The Federalist, Vanessa Brinkmann, senior counsel in the Justice Department’s Office of Information Policy, authorized the release the week before publication. Some of the photos are partially or fully redacted. Visible file labels include “Iraq/Syria ’14,” “Foreign Policy” and “Schumer DACA,” and YourNews reported others reading “Obama Doctrine — Atlantic,” “Gmail Backup Codes” and “Zwonitzer Agenda Book Material,” a reference to Biden’s ghostwriter, Mark Zwonitzer.
The Federalist reported that agents wore gloves in several of the photos and that the records were kept “neatly organized.” The Oversight Project says the government fought for years to keep the pictures from the public. Its vice president of litigation, Jeff Clark, said the Biden material “was managed with kid gloves to protect a reputation.” The group’s president, Mike Howell, described its persistence simply: “The Oversight Project is a dog on the bone.”
To be fair about what pictures can prove: evidence photos are staged for documentation by design, and as YourNews noted, layouts alone do not establish why investigators made particular choices. The images are not a confession. But they are a record, and the record raises a fair question about why one former official’s documents were photographed in tidy boxes and the other’s were laid out for the cameras.
The Mar-a-Lago picture, explained by prosecutors
The FBI searched Mar-a-Lago on Aug. 8, 2022. Later that month, the Justice Department released the now-famous photo of documents on the floor, several topped with classified cover sheets. For nearly two years, it was treated as a snapshot of how Trump kept national secrets.
Then, in a June 24, 2024, filing, Special Counsel Jack Smith’s own team described what actually happened. As CBS News reported, agents removed classified documents from boxes, put placeholders in their place and noted which box each came from. The FBI’s Evidence Response Team then photographed the documents, with the cover sheets added by FBI agents, next to the box where they had been found. When agents ran out of preprinted cover sheets, they used blank paper with “handwritten annotations to identify the document,” according to the filing.
In other words, the colorful cover sheets in the most widely circulated image of the case were not part of how Trump stored his papers. The government added them. The Oversight Project now argues, as The Federalist reported, that no cover sheets appear in the Biden photos at all.
Two cases, two outcomes
The legal endings could not have been more different. Trump was charged in a 40-count indictment, including willful retention of national defense information and obstruction. U.S. District Judge Aileen Cannon dismissed that case in July 2024, ruling that Smith’s appointment as special counsel violated constitutional requirements.
Biden was never charged. Special Counsel Robert Hur’s February 2024 report found that “Our investigation uncovered evidence that President Biden willfully retained and disclosed classified materials after his vice presidency when he was a private citizen.” Hur nonetheless concluded that “no criminal charges are warranted in this matter.” Among his reasons was the jury: Biden, Hur wrote, would likely present himself “as a sympathetic, well-meaning, elderly man with a poor memory.”
Hur also drew distinctions in Biden’s favor, and they belong in the record. He wrote that Trump, according to the indictment, “not only refused to return the documents for many months, but he also obstructed justice by enlisting others to destroy evidence and then to lie about it,” while Biden turned documents over, consented to searches and sat for a voluntary interview. Those were allegations in an indictment that never reached a jury, and the case was thrown out.
Why it still matters
The documents cases were never just about paper. They became the centerpiece of a political narrative: Trump the reckless lawbreaker, Biden the careless but innocent grandfather. The visuals did a great deal of that work. One side got a staged-looking floor spread on every front page. The other got neat boxes nobody saw until now.
George Papadopoulos, a former Trump campaign foreign policy adviser, made the argument on OAN: “What the American people are witnessing with these newly released files is how dangerous a two-tiered justice system in America really looks like.”
The Oversight Project says it wants the Justice Department to reopen the Biden matter, citing federal statutes on the removal and retention of classified material, according to YourNews. Whether or not that ever happens, the public now has something it did not have before: the full picture, literally, of how the same government handled two men accused of the same kind of conduct.
Gloves for one president and cover sheets for the other is not equal justice, it is a photo op with a verdict already written.
